E-marketing terms

In order to send any electronic communication as part of our Partner Program, and to adhere to the remaining terms and conditions of our Agreement with you, you are to ensure that:

  • • You have obtained clear and specific consent from the proposed recipient(s) prior to sending any such communications, which consent shall have been obtained through an opt-in mechanism. For instance, the proposed recipient(s) must have actively ticked a box indicating their willingness to receive marketing communications from you promoting third-party goods and services. The opt-in box must not be pre-populated

  • • The communication explicitly identifies and promotes our Site and/or Operator Sites or services as the subject matter of the communication.

  • • If such communication comprises any promotional offers, competitions, or games, you must clearly identify the promotion, competition, or game as such, and set out any conditions which prospective Players must satisfy to qualify for the promotion, competition, or game clearly and unambiguously in the communication.

  • • You must not send any such communications to individuals under the age of 18, or the age of majority in the country of the proposed recipient(s) of any such communication, whichever is higher.

  • • You must not employ any viral marketing techniques as part of your electronic marketing activities.

  • • Any such communications must solely promote us, our Site and/or Operator Sites (and not any third parties, third-party services, or third-party sites) and must not contain any content other than Operator Content.

  • • You must include your true name (e.g., the "From" line of any email) and not a sales pitch or marketing message. Any such communication must explicitly identify you as the sender of the communication, and you must not falsify or attempt to conceal your identity.

  • • You must not deceive the recipient(s) with respect to the content and purpose of the communication

  • • You must provide a conspicuous, adequately functioning "opt-out" or "unsubscribe" option in each communication.

  • • The communication must contain a valid address to which the recipient can reply to opt out/unsubscribe from future marketing communications. The reply address must remain active for at least thirty (30) days following the transmission of the communication.

  • • You must promptly honour any opt-out/unsubscribe request made by any recipient of the communication. You must not send any further marketing communications to any individual who has indicated (by any means) their desire not to receive any further marketing communications.

  • • You must include a physical business address in any such communication.

  • • You must include a link to your privacy notice in any such communication.

  • • You must not transmit any such communications to any individual who has registered on any relevant register of persons who do not wish to receive marketing communications.
